This month we discuss:
Automobile roof crush causes over 10,000 fatal injuries each year. Auto defects in SUV's cause damaging and sometimes fatal roof crush in vehicle rollovers. Safe designs have been available since the 1950's, but manufactures refuse to correct these defects generally due to cost. These hidden defects are generally unknown to the average consumer.
Two teenagers were killed in an SUV rollover. Two teenagers were killed and others were severely injured when their Chevy Tahoe rolled over several times. This injury could have been prevented had the vehicle been designed with laminated side windows and a stronger vehicle roof.
NHTSA overlooks thousands of tire defects. Over 442,000 Chinese tires were ultimately recalled after the problem and defect was initially overlooked by NHTSA. NHTSA allowed these thousands of tires to remain on the road despite hundreds of consumer complaints. Unfortunately, these complaints were lodged with NHTSA's secret database of defects. This delay in protecting consumers could have prevented had NHTSA made its secret database of defects available to consumer justice attorneys such as Ricci~Leopold.
Excellent Results in Payday Lending Cases. Florida consumers win in a ruling striking down illegal payday lending practices and allowing a class of consumers to pursue their actions in court. West Palm Beach Circuit Court recently held that an unconscionable and unenforceable provision preventing class action claims could not stand. Due to the work of Public Justice and the Ricci~Leopold firm, the court found that claims for unusually high and illegal interest rates can be pursued on behalf of all consumers who were charged sometimes as high as 45% interest.
